Student Data Privacy Policy

MyEdSpace, Inc. ("MyEdSpace," "we," "our," or "us") provides live mathematics instruction to K–12 students across the United States. We take the privacy and security of student data seriously, and we recognize that students and families deserve clear, enforceable commitments about how student information is used. This Student Data Privacy Policy describes those commitments and explains how we comply with state student data privacy laws that go beyond the federal Children's Online Privacy Protection Act (COPPA).

Our Core Commitment

MyEdSpace will never sell student data. We will never use student data to serve targeted or behavioral advertising to students or their families. We will never use student data to build profiles of students for purposes unrelated to their education. Student data is used solely to provide, maintain, and improve the educational services that students and schools have engaged us to deliver.

These are not aspirational statements — they are operational commitments embedded in our agreements with school and district partners and in the technical and organizational controls we apply across our platform.

Data We Collect and Why

MyEdSpace collects only the student data that is reasonably necessary to provide our live instructional services. This includes the student's name, grade level, course enrollment, and academic progress within our platform (such as assessment results and session attendance). We may also collect data generated during live class sessions, including participation records and, where sessions are recorded for educational review, recordings of those sessions.

We use this data to assign students to the appropriate course level, deliver live instruction, track academic progress, communicate with parents and guardians about student performance, and improve the quality of our instructional content and teaching methods. All data use is tied to the provision of the educational service. We do not use student data for product development or research that is unrelated to improving the educational experience we provide.

No Sale of Student Data

MyEdSpace does not sell, rent, trade, or otherwise transfer student data to third parties for commercial purposes — ever. This prohibition applies regardless of whether the student enrolled through a family subscription or through a school or district agreement, and regardless of the student's age, state of residence, or the specific data involved. We do not receive any compensation in exchange for student data, and we do not allow third parties to use student data for their own commercial purposes.

No Advertising Use of Student Data

MyEdSpace does not use student data to target advertising to students, to facilitate advertising by third parties, or to create advertising profiles based on students' online activities. Students using our platform will not see behaviorally targeted advertisements, and we will not share student data with advertising networks or data brokers.

Sharing with Service Providers

To operate our platform, MyEdSpace engages third-party service providers for functions such as cloud infrastructure, video conferencing, customer support tooling, and payment processing. These providers may have access to student data only to the extent necessary to perform their contracted functions, and they are required by contract to use student data exclusively for that purpose, to maintain appropriate security safeguards, and to comply with applicable student data privacy laws. We do not permit service providers to use student data for their own independent purposes.

Data Retention and Deletion

MyEdSpace retains student data for as long as necessary to provide the educational service and for a reasonable period thereafter to address billing inquiries, legal obligations, or disputes. When a student's account is closed or a school or district agreement concludes, we will delete or de-identify student data within a reasonable time, consistent with our data retention schedule and any applicable legal requirements.

Parents, eligible students, and authorized school or district representatives may request deletion of student data at any time by contacting us at privacy@myedspace.com. We will respond to verified deletion requests promptly and confirm when deletion has been completed, except where retention is required by law.

School and District Operator Agreements

When MyEdSpace provides services to a school or school district, we enter into a written data processing agreement that governs our access to and handling of student data. These agreements specify the categories of data we may access, the purposes for which we may use it, our security obligations, and the conditions under which data must be returned or deleted at the conclusion of the engagement. School or district operators may request a copy of our standard operator agreement by contacting us at privacy@myedspace.com.

Applicable State Laws

In addition to COPPA, several states have enacted laws that specifically address the collection, use, and protection of student data by operators of online educational services. MyEdSpace is committed to complying with all applicable state student data privacy laws, including the following:

California — Student Online Personal Information Protection Act (SOPIPA), Cal. Bus. & Prof. Code § 22584 et seq. SOPIPA prohibits operators of online services that are designed and marketed for use by K–12 students from using covered information for targeted advertising, building profiles for non-educational purposes, selling student data, or disclosing covered information in ways not permitted by the statute. MyEdSpace's practices are designed to comply fully with SOPIPA's requirements for all students, not only California residents.

New York — Education Law § 2-d. New York's Education Law § 2-d imposes requirements on educational technology vendors, including obligations to maintain data security, limit data use to educational purposes, prohibit the sale of student data, and provide parents and eligible students with rights to access and correct their data. When MyEdSpace contracts with New York schools or districts, our operator agreements comply with § 2-d and the associated Commissioner's Regulations at 8 N.Y.C.R.R. Part 121.

Colorado — Student Data Transparency and Security Act, C.R.S. § 22-16-101 et seq. Colorado's Student Data Transparency and Security Act governs the collection and use of student data by operators of educational technology services. MyEdSpace complies with the Act's requirements regarding data use limitations, security, and the rights of parents and students with respect to their data.

Texas — Student Privacy Protection Act (TX SCOPE Act), Tex. Educ. Code § 32.151 et seq. The Texas SCOPE Act prohibits operators from using student data for non-educational commercial purposes, selling student data, or disclosing it in violation of the Act. MyEdSpace's commitments with respect to student data apply to all students served, including those enrolled through Texas schools and districts.

Residents of other states that have enacted student data privacy legislation may also contact us to understand how MyEdSpace's practices apply to their state's requirements. We monitor developments in state student data privacy law and update our practices as new laws take effect.

Security

MyEdSpace implements administrative, technical, and physical safeguards appropriate to the sensitivity of student data, including encryption of data in transit and at rest, access controls limiting data access to personnel with a legitimate need, and regular security assessments. In the event of a security incident involving student data, we will notify affected schools, districts, parents, and students as required by applicable law and as promptly as circumstances permit.

Changes to This Policy

MyEdSpace may update this Student Data Privacy Policy from time to time to reflect changes in our practices, applicable law, or regulatory guidance. When we make material changes, we will update the "Last updated" date at the top of this page. If we make changes that materially affect the rights of students or parents, we will provide advance notice by email or through a prominent notice on our website before the changes take effect.
