FERPA Notice

This FERPA Notice describes how MyEdSpace, Inc. ("MyEdSpace," "we," "our," or "us") handles education records in connection with the Family Educational Rights and Privacy Act of 1974 (FERPA), 20 U.S.C. § 1232g, and its implementing regulations at 34 C.F.R. Part 99. We are committed to protecting the privacy of student education records in every context in which we operate.
What FERPA Is
FERPA is a federal law that protects the privacy of student education records. It grants parents certain rights with respect to their children's education records, and those rights transfer to the student — who then becomes an "eligible student" — when the student turns 18 or attends a school beyond the high-school level. Schools covered by FERPA must obtain written consent from the parent or eligible student before disclosing personally identifiable information from education records, subject to limited exceptions authorized by the statute.
How MyEdSpace Primarily Operates
MyEdSpace predominantly offers live math instruction directly to families. In this direct-to-family model, parents or legal guardians enroll their children and manage their accounts. In that context, MyEdSpace is not acting as an educational agency or institution subject to FERPA, and FERPA does not govern our relationship with you. Our collection and use of information in this context is described in our Privacy Notice and Children's Privacy Notice.
However, MyEdSpace may also be contracted by schools, school districts, or other educational agencies to provide instructional services directly to enrolled students as part of a school program. The remainder of this notice explains our practices when we operate in that capacity.
MyEdSpace as a School Official
When MyEdSpace is engaged by a school or district to deliver educational services, we act as a "school official" with a legitimate educational interest as contemplated by FERPA. In this role, MyEdSpace performs services or functions that the school would otherwise use its own employees to perform, and we access education records only to fulfill those instructional and administrative functions. We do not use education records for any purpose other than the services we are providing to the contracting school or district.
As a condition of any such engagement, MyEdSpace enters into a written agreement with the contracting school or district that governs our access to and treatment of education records, consistent with FERPA's requirements for disclosures to school officials.
Education Records We May Access
When acting on behalf of a contracting school or district, MyEdSpace may have access to education records that include student names, grade levels, course enrollment information, academic performance data (such as assessment results and progress within our platform), class schedules, and any other information that the school or district determines is necessary for us to provide the contracted services. We access only those records that are reasonably necessary to carry out our educational functions.
How We Protect Education Records
MyEdSpace maintains administrative, technical, and physical safeguards designed to protect education records against unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit and at rest, role-based access controls that limit access to authorized personnel, and regular security assessments. Our staff and contractors who handle education records are trained on applicable privacy requirements and are bound by confidentiality obligations.
Non-Disclosure of Education Records
MyEdSpace does not disclose personally identifiable information from education records without prior written consent from the parent or eligible student, except as permitted by FERPA. Permitted disclosures include, for example, disclosures to other school officials with legitimate educational interests, disclosures required by law or court order, and disclosures in connection with a health or safety emergency. We do not sell education records, and we do not use education records for advertising or to build profiles of students for non-educational purposes.
Rights of Parents and Eligible Students
Under FERPA, parents and eligible students have the following rights with respect to education records maintained by an educational agency or institution. To the extent that MyEdSpace holds education records on behalf of a contracting school or district, we will cooperate with the school or district in facilitating the exercise of these rights:
Right to Inspect and Review. Parents and eligible students have the right to inspect and review the student's education records within 45 days of the day the school receives a request for access. MyEdSpace will work with the contracting school or district to respond to such requests.
Right to Request Amendment. Parents and eligible students may ask the school to amend a record they believe is inaccurate, misleading, or otherwise in violation of the student's privacy rights under FERPA. If the school decides not to amend the record as requested, it must inform the parent or eligible student of the decision and advise them of their right to a hearing. MyEdSpace will correct or delete any data in records it holds upon instruction from the contracting school or district.
Right to Consent to Disclosures. Parents and eligible students have the right to consent to disclosures of personally identifiable information from education records, except to the extent that FERPA authorizes disclosure without consent.
Right to File a Complaint. Parents and eligible students have the right to file a complaint with the U.S. Department of Education concerning alleged failures by an educational agency or institution to comply with FERPA. Complaints may be directed to the Family Policy Compliance Office, U.S. Department of Education, 400 Maryland Avenue SW, Washington, D.C. 20202.
How to Exercise Your Rights
If you are a parent or eligible student and have questions about how MyEdSpace handles education records in connection with a school or district engagement, or if you wish to submit a request related to your rights under FERPA, please contact us at privacy@myedspace.com. Where your rights must be exercised through the contracting school or district, we will direct you to the appropriate contact and cooperate fully with the school's or district's response process.
Changes to This Notice
We may update this FERPA Notice from time to time to reflect changes in our practices or applicable law. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review this notice periodically.
