Overview
MyEdSpace, Inc. ("MyEdSpace," "we," "our," or "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent as described in this policy.
If you believe that any content available on or through the MyEdSpace platform infringes a copyright that you own or control, you may submit a written takedown notice to our designated DMCA agent using the contact information provided below. Please read this policy carefully before submitting a notice, as we act only on notices that satisfy all statutory requirements.
Designated DMCA Agent
MyEdSpace has registered a designated agent with the United States Copyright Office to receive notifications of claimed copyright infringement. All DMCA notices and counter-notifications must be sent to:
MyEdSpace DMCA AgentMyEdSpace, Inc.
Attn: DMCA Agent
Email: dmca@myedspace.com
We strongly recommend submitting notices by email to ensure timely receipt and processing.
How to Submit a Valid Takedown Notice
To be effective under the DMCA, your written takedown notice must include all of the following elements. Incomplete notices may not be acted upon.
1. Identification of the copyrighted work. Describe the copyrighted work you claim has been infringed. If your notice covers multiple works, you may provide a representative list. Include any registration numbers or other identifying information if available.
2. Identification of the infringing material. Identify the specific content on the MyEdSpace platform that you claim infringes your copyright. Please provide the full URL(s) or a sufficiently detailed description of the location of the material so that MyEdSpace can locate it. General descriptions that do not allow us to identify the precise content will not be sufficient.
3. Your contact information. Provide your name, postal address, telephone number, and email address so that MyEdSpace and the alleged infringer can contact you.
4. Good faith statement. Include the following statement: "I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or applicable law."
5. Accuracy and authority statement. Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed."
6. Signature. Provide your physical or electronic signature. An electronic signature may consist of your full legal name typed at the conclusion of the notice.
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, the content provider, or MyEdSpace.
Our Response to Takedown Notices
Upon receipt of a valid and complete DMCA takedown notice, MyEdSpace will act expeditiously to remove or disable access to the allegedly infringing content. We will make a good faith attempt to notify the user who posted the content that it has been removed or disabled, and to provide that user with a copy of the takedown notice so they may exercise their right to submit a counter-notification if they believe the content was removed in error.
Counter-Notification Procedure
If you believe that content you posted on the MyEdSpace platform was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our DMCA agent at the address above. To be effective under 17 U.S.C. § 512(g), your counter-notification must include:
1. Identification of the removed material. Identify the specific content that was removed or disabled and the location (URL) at which it appeared before it was removed.
2. A statement under penalty of perjury. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
3. Your consent to jurisdiction. Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, in any judicial district in which MyEdSpace may be found, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."
4. Your contact information and signature. Provide your full name, postal address, telephone number, email address, and your physical or electronic signature.
Upon receipt of a valid counter-notification, MyEdSpace will forward it to the original complaining party and inform them that the removed content may be restored in 10 to 14 business days unless the complaining party files a court action seeking to restrain the alleged infringer. If no such action is filed, MyEdSpace may, in its discretion, restore the content.
Repeat Infringer Policy
It is the policy of MyEdSpace to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. MyEdSpace will consider a user a repeat infringer if we receive two or more valid and complete DMCA takedown notices identifying content uploaded or posted by that user. We reserve the right, in our sole discretion, to terminate an account upon the first valid notice if the circumstances warrant, including where the infringement appears willful or egregious.
MyEdSpace also reserves the right to limit or terminate the accounts of users who, in our judgment, abuse the DMCA process by submitting takedown notices in bad faith.
Changes to This Policy
MyEdSpace may update this DMCA Policy from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our platform following any update constitutes your acceptance of the revised policy.
